      Hello. I have noticed a great deal of confusion regarding how to use the report feature and what is expected regarding reports, so I am making a clarification announcement to users who may be unfamiliar with how the report feature works. Please note we have this rule regarding reports: 16.  Do report. Do not make frivolous reports (such as "I don't like this person"). Frivolous reports will result in a warning and possible ban. a. When reporting, please give a reason. Reports citing what rule the post is breaking and giving some information are way more valuable and will get the issue resolved faster. (Reports with no explanations sometimes require mods to go through and skim the entire thread to find out what's going on. Please save us time if you can). b. Don’t waste the mods’ time. Report people for breaking the rules, otherwise don’t report. [Rules in their entirety can be found here.] We also have a wonderful tutorial on how to use the report feature created by one of our former moderators which you can find here. In essence, we enforce the rules as they are written. In a rare occasion there may not be a direct violation but the user is still conducting themselves inappropriately and how we handle that is up to the moderators discretion. We do our best. We also encourage you to use the report feature to report posts that have been edited down to nothing or if you double posted and would like your double post hidden. Also, please note that we do not provide updates on reports. We get far too many to be able to keep up with every one. You are welcome to message a moderator to ask about your report, but please know that we cannot and will not divulge any information on whether we banned the user you are reporting. Simply that we have taken appropriate action. I hope this helps provide further clarification on how to use the report feature. Should you have any questions not clear in these instructions, please feel free to message me or Nyx. Thank you. *Please allow up to 3 business days (as we tend to be slower on weekends) for a response and for reports to be cleared.

Ty subpoenaed to appear in court, likely the reason Martinez Hzu got involved. Major shades of Rudy Giuliani getting subpoenaed in the Trump case here. This is pretty uncommon.

 

 

Just when I think this can't get funnier. 

 

Lemoine wants Screech, he is going to make him pay, and the easiest way? Follow the money.

Ah sweet karma. Ty is going to cry when he has to be a witness on court. Five bucks says he has a mental breakdown when someone competent goes after his ass.

That Screech has been trying to tie into alt-right circles for the last 2 years?
That Screech has painfully barebones knowledge beyond general law, yet sells himself as a specialist?
That Screech billed himself as a notary expert despite any banker can be a notary?
That Screech ran away to bumfuck MN to try and get off the grid until Youtube paid the bills?

 

Nah....I expect one of his kids to pull an Pennington later on. I mean he is a lawyer

Good evening #Threadnought, let's talk about the hearing that was held this afternoon now that I've finished work. If I miss anything, well, sorry, I was the only one in the gallery and I'm working off of my notes and memory. 
Takeaways: Slatosch will not be deposed right now, may be compelled to testify later. Judge Chupp does not like the idea of calling Ty to testify at all and seems like he would prefer any alternative to that. Sanctions on Lemoine dismissed.
I mentioned that the gallery was barren, but the plaintiff's chairs were not. Four of Vic's lawyers were present, though the only two I can name are Martinez and Ty. Only Martinez spoke for the plaintiffs. For the defense were @TXantislapplaw and his boss(?) 
Lemoine handled all questions on fees and deposing Slatosch and his boss was there to argue on the sanctions against him. Listening in on the phone were the lawyers for the other defendants. 
Kicking things off, Chupp wasn't entirely happy with the distinction Lemoine was suggesting between "ruling" and "final judgement" and seemed inclined to think that the discovery stay was still in place. Chupp also questioned why Lemoine didn't do this pre-hearing. 
This seems to mostly be probing Lemoine though, as when Martinez tried to bring up the same point Chupp pivoted to him with the fact that there wasn't exactly much time to depose a surprise affiant. Martinez suggested that Lemoine et al could have requested a continuance. 
Martinez argued that since Lemoine et al are being awarded costs, any litigation they undertake is automatically within the financial interest of Vic's team in response to the argument that if they cared about cost they could just not show up to the deposition.  
Bottom line ended up being that Lemoine argued he can find out what he wants from Slatosch, or from Ty. Chupp seemed inclined towards Slatosch being the source instead of bringing up an attorney to testify.  
When questioned if he would've subpoenaed Slatosch, Lemoine said yes but that he cannot due to him living outside of the 150 mile radius of jurisdiction for Chupp's court. Chupp (jokingly?) suggested Lemoine could serve Slatosch if they ran into each other at DFW Airport. 
A very interesting thing Chupp said that I might be reading too much into: Lemoine argued he needs to depose Slatosch in order to establish frivolousness for sanctions. Chupp retorted that he should be able to accomplish that with the filings alone. 
Chupp ultimately settled on saying no to deposing Slatosch *at this time* due to the possibility of it confusing things. Left the door open for him being deposed for the appeals court evidentiary hearing. And, oh, the appeals... 
The early notice of appeal has confused things so much that even Chupp is concerned by the pandora's box it unleashed. There is possibility that the appeals court considers the early notice effective if they disagree with Chupp on the significance of his ruling. 
Let's lay out the situation here. If the ruling starts the appeals clock, then the notice was timely filed and - this is the important part - the clock has by now ran out. If the final judgement starts the clock, then it was filed early. There are a few paths on this. 
If Vic's team withdraws their notice of appeal, then in one scenario they're fixing a mistake, but in another they're waiving their appeal rights. If they continue it, then there is the chance that the appeals court bench slaps Chupp for continuing proceedings. 
In response to all of this Chupp basically just told Martinez et al to fix it and said on the record that his ruling was not a final judgement. Unsure what Martinez is going to do to try and fix it but watch the filings I guess!
Lemoine's boss then stood to ask if the sanctions against Lemoine were dismissed. Chupp said yes. No argumentation, just an immediate ruling. Martinez did not contest. 
Next hearing is on the 21st, Vic is set to testify. Currently, Ty is also set to testify! Chupp informed Martinez that he must file a motion to squash to prevent. Feel free to ask questions, IANAL so I may have misjudged significance and not included everything of relevance. /fin 
One thing I forgot to mention: the hearing was *short*, start time was for 1:30 and we were out by 2.

Not really Martinez will most definitely file to quash

Currently, Ty is also set to testify! Chupp informed Martinez that he must file a motion to squash to prevent.

Either way we get to see Ty cry! :D I am all here for horrible people to finally break down.

Also I am confused about the appeals. Is it being encouraged to do the appeals or is it being encouraged to drop the appeals? I was really nto sure on that part but I am not a law person.

tbh it's too late for appeals. They didn't file in time. So it doesn't matter what they encourage. At least as far as I remember.

From what lawtwitter is saying, Chupp is allowing Vic's due process for appeal as is his right, but because Percy is a fucking moron and filed his appeal early, there is now a jurisdictional dispute that if Vic withdraws his appeal, then he loses his right to appeal. Or if Chupp continues with the suit the appellate court may rule the appeal was valid and Chupp was out of his jurisdiction, and will nullify things. The last thing anyone wants is Vic to be denied due process.
